I – Introduction
Namo Sakyamauni Buddha!
Dear the most venerable Bhikkhu Sangha!
Dear all the Dharma friends!
The Buddhist Congregation of India established on 19/02/2020 at Bodhicariya Buddhist Vihara, Address:  Maitree Nagar, Chakma road, New Town, Rajarhat, Kolkata. The founder was Ven. Thich Hanh Dinh, a Vietnamese monk. He came to Norway in 1989; He became a Buddhist monk in 1997 at Vien Giac Monastery in Germany. His master is the most ven. Thich Nhu Dien. He did organise a Sangha meeting whom presented the most venerable master Bimal Bhikkhu, Ven master Sadhananda Chakma, Ven. Sanghapala Thera, Ven. Jina Piya Thera, Ven. Anuruddho, Ven. Sumana Tisha Thera, Ven. Jina Piya Thera, Ven. Povangkar Thera, Ven. Loka Jyoti Thera, Ven. Saranapal Mahathera, Ven. Purna Nanda Thera, Ven. Shanti Ratna Thera.etc. . During meeting, everybody were delighted to agree to establish Buddhist Congregation of India.

India have many religions. Buddhism is one of the biggest religion in India. Many countries had been being Buddhist countries such as Thailand, Myanmar, Sri Lanka, China, etc.  and Nowadays, Buddhism had spread to Australia, America, Europe, ect. . We can say that Buddhism had become a international religion in the world. Everyone did know that Buddhism came from India. So Indian Buddhism was really original Buddhism and Buddhism was a Buddhist country in the Mauryan dynasty, particular in the Ashoka king`s times. However, nowadays Indian Buddhism is a small number in India, about 0,7 % of Indian population. Therefore, nobody knew who are the representatives of Indian Buddhism, Indian Sangha and where they are ,etc. . These are reasons that we would like to organise Buddhist Congregation of India. It will be a official organisation that is representatives of Buddhism and Sangha community in India. Indian goverment, foreigner country can know us and contact us through Buddhist Congregation of India. Particular, we will be a membership of International Buddhist council. Besides, our congregation aims as following:
1 - BCI set up Sangha community more properly and stronger. All Buddhist Monks gather together, cooperate together, help each other and live harmony in Sangha community. Then Sangha community will be stronger and stronger. Monk is a member of Sangha community. So, monks should live harmony in Sangha community. If you live separately. You are not Buddhist Sangha.
2 – BCI will organise the Sila transmittion ceremony for Sangha.
3 – BCI creates to have harmony and good connection in Sangha community. BCI will have Buddhist national meeting and festivals in yearly.
4 – BCI provides official certificates for all Buddhist Vihara and Sangha community, even all Buddhists.
5 - BCI gives education for Monks, Nuns and Buddhist through Buddhist school and meditation courses etc.
6 - BCI organises Buddhist activities and meditation courses for students and teenagers.
7 - Buddhist Congregation of India is  a official organisation. So BCI is able to protect Sangha community and other things.
8 – BCI will help all Viharas developing Buddhism.
9 – BCI can help constructions in the remote area.
10 - BCI notify Buddhist informations to all viharas by online.
11 – BCI is able to do charitable works in society.
         BCI will try on our best to focus the development of Buddhism in India and oversea. These are  Sangha community`s duties and responsibilities.

III - OBJECT OF SOCIETY:
1 - BCI set up Sangha community more properly and stronger. All Buddhist Monks gather together, cooperate together, help each other and live harmony in Sangha community. Then Sangha community will be stronger and stronger. Monk is a member of Sangha community. So, monks should live harmony in Sangha community. If you live separately. You are not Buddhist Sangha.

3 - BCI will organise the Samanera sila and Bhikku sila ordination.
4 – BCI creates to have harmony and good connection in Sangha community. BCI will have Buddhist national and international meeting and festivals in yearly.

RULES AND REGULATIONS
OF
BUDDHIST CONGREGATION OF INDIA
 
1. DEFINITION:
A)The word: “Society” wherever mentioned means “BUDDHIST CONGREGATION OF INDIA”
B) Logo: Logo is a circle; background is white; writting is red; A symbol as Dharma wheel is yellow.
 
2. A) AREA OF OPERATION:
The area of operation of the Society shall be all over India and International.
B) JURISDICTION:
The Jurisdiction of the Society shall be Kolkata only.
 
3. FINANCIAL YEAR:
The financial year of the Congregation shall be 1st Jan to 30 dec of every year.
 
4. MEMBERSHIP:
         The Membership of Congregation is open to Indian Bhikkhu monk who completed age of 20 years who agree with the aims and objects of Congregation. They shall have to abide by Rules and Regulations of the said Society. Membership will be allowed after consideration and approval of Managing Committee. Managing Committee keeps the right  to reject any Application for membership with giving specific reason.
 
5. TYRES OF MEMBERS:
All members are free donations.
 
6. CEASING TO BE A MEMBER:
A person shall Ipso-facto to cease to be a member and shall be removed as such by Managing Committee.
a) On his/her dealth.
b) On his/her resignation of membership.
c) On his/ her convicted of criminal offence.
d) If he/she breaks the Rules and Regulations of the Congregation.
7. MANAGING CONGREGATION:
         The Management and administration of the said Congregation shall be carried out on and managed by the Managing Committee which may pay all legal expences incurred in promoting and registration of the said Congregation, are mentioned herein these Rules and Regulations and specifically required to be exercised by the Sangha in General Body Meeting.
         The Managing Committee shall be constituted of the following members:

General Secretary               1
Vice Secrectary                           2
Treasurer                            2
Congregation Members unlimited
         The Managing Committee so constituted as aforesaid shall elect from amongst themselves the Office-bearers. Any retiring member of the Managing Committee shall be eligible for re-election. The Managing Committee however,  may fill up the casual vacancies. Any person was appointed by the Managing Committee shall hold office for the remaining period only.
 
8. POWER OF THE MANAGING COMMITTEE:
         The Managing Committee shall work and have full powers and authirity to do all acts, matter, things, deeds which may be necessary or expedient for the purpose of and in particulars to the following:
A) To look after, manage, supervise and control the management of the said society and its properties.
B) To admit or reject new member and accept resignation of the members.
C) To have audited statement of accounts prepared every year for submission to the registrar of Societies & Income Tax and any other authority as may be required as the law for the time being in force, if any.
D) All clauses herein are intended to secure exemption from Income Tax on the Income of contributions and donations to the Trust and any clause or portion of this Deed of Trust which in inconsistent with or repugnant to the sections of the Income Tax Act, 1961 as amended, substituted or modified from time to time, shall be deemed to be deleted or modified with effect from the date on which the sections to which the clause or part of clause is repugnant or inconsistent comes into force.
E) To accept donation in cash or in kind on such condition and without condition.
F) To make an appeal to the people for general donation as per the decision of the General Body.
G) To appoint such committee with such powers as the Managing Committee may think  fit and proper, for such purpose. And/or to dismiss the same when the purpose is full-filled.
H) Generally, to do all such other acts, things as are incidental or conducive to the attainment of the above powers and duties or anyone or more of them and the aims and objects specified in the Memorandum of Congregation.
 
9. MEETING OF THE MANAGING COMMITTEE:
         All Delegates of the Managing Committee shall have monthly and yearly meeting. Monthly meeting report financials, application documents and activities; Yearly meeting  are twice times on 01/06 and 01/12. It reports all activities of Congregation. If necessary to conduct the affairs of the said Congregation. Minimum 7 days notice of meeting in writting/by hand delivery should be given to the members of Managing Committee.
 
10. REQUISITION MEETING OF MANAGING CONGREGATION:
         The requisition meeting of the Managing Committee may be convened upon a requisition made in writting by President and/or any 3/5 Delegates of Managing Congregation. Such requisition shall specify the subject of the meeting proposed to be called and must be signed by all the requisitionists and shall be delivered at the office of the Congregation.
         On receipt of the requisition the Managing Committee shall forthwith proceed to convene the meeting. If, Managing Committee fails to do so, then President and/or the requisitionist themselves may convene such meeting within 10 days from the delivery of such requisition. Quorum for the requisition meeting shall be 3/5th  Delegates present in the meeting of the managing Committee.
11. QUORUM FOR THE MANAGING COMMITTEE:
         3/5th  Delegates present in the meeting shall form a quorum of the Managing Committee. If, meeting is adjourned for want of quorum shall be held an hour later at the same place and Delegates present shall form the quorum. But, no business other than that is specified in the notice be transacted in such meeting.
 
12. MINUTE TO BE KEPT:
         Managing Committee shall have to maintain minute book which shall appear:
A clear report of the proceeding of such meeting.
A copy of each notice convening the meeting of Managing Committee and General Body and of each circular in which the decision has been arrived at by the Managing Committee. Minutes shall be read over the next meeting of the Managing Committee and when confirmed shall be signed by the President of such meeting.
 
13. OFFICE BEARERS AND THEIR DUTIES:
I – MANAGING COMMITTEE:
1 – SENIOR MONK COMMITTEE:
They are consultants for Managing Committee how to manage  Management, administration of Congregation and how to develope Buddhism. They shall look after, manage, supervise Buddhist school, financials, properties, all documents and Congregation `s activitives. They control and check personality, education, practice, and curriculum of all candidates in election.
2) PRESIDENT:
The President of Congregation shall preside over the meeting and regulate all the meetings of Managing Congregation. The President shall in additional to his rights of voting as a member have a casting vote in case of a tie.
3) HEAD VICE PRESIDENT:
The Vice President shall assist the President in his work and shall perform his duties in his absence.
4) VICE PRESIDENT FOR SANGHA IN CHARGE:
He controlls and takes care of Monks and Nuns.
a) VICE SANGHA IN CHARGE:
He assists and replaces Sangha community in charge. He control and look after all monks.
b) NUN COMMUNITY IN CHARGE:
She controlls and takes care all the Nuns.
5) VICE PRESIDENT FOR FINANCIAL IN CHARGE:
He asks donation for BCI `s activitives.
 
II – EDUCATION COMMITTEE:
6)  VICE PRESIDENT FOR EDUCATION IN CHARGE:
He takes care of Buddhist school and meditation courses.
a) Assistant of education in charge for Buddhist school:
         He assists Vice President to manage Buddhist school.
b) Assistant of education incharge for teenagers:
He assists Vice President for education to students and teenagers.
 
III – ADMINISTRATION COMMITTEE:
7) TREASURER: 
The Treasurer shall ordinarily receive all payments made to society and pass the necessary receipts and shall account books.
1 - Vice Treasurer:
         He takes care of expenditure of Congregation `s activitives.
2 - Vice Treasurer:
         He takes care of expenditure of Buddhist School.
 
8) GENERAL SECRETARY:
The Secrectary shall accept application for memberships and submit to the Managing Congregation and he will maintain Membership Register up to date. He shall maintain minute book and attend daily routine correspondence. The Secrectary shall maintain all other necessary books.
1 - VICE SECRETARY:
The Vice Secrectary shall assist the Secrectary in his work and shall perform his duties in his absence. He take care of Congregation `s documents.
2 - VICE SECRETARY:
         He shall take care of Buddhist school `s documents.
3 - VICE SECRETARY FOR BUDDHIST INFORMATION IN CHARGE:
He notifys Buddhist informations to public by newspapers and online .ect . .
4 - VICE SECRETARY FOR BUDDHIST CULTURE IN CHARGE:
He is representative of the Buddhists.
5 - CHARITY IN CHARGE:
He do social works for education, disease, storm, earthquake .ect..
* MANAGING COMMITTEE:
He shall attend all the Congregation Meeting and shall actively participate in deliberation as agenda. He shall assist, advice, suggest, guide and cooperate with other Delegates of Congregation for proper discharge of their duties jointly and severally. He shall be bound to offer any service to the betterment and uplift of the Congregation.
 
14. GENERAL BODY MEETING:
         The General Body Meeting of the Congregation shall be held twice in a year on 01/06 and 01/12. Meeting date can be changed by Managing Committee.
 
15. EXTRA ORDINARY GENERAL MEETING:
         An Extra Ordinary Body Meeting may be conveyed by the Managing Committee of its own motion, or upon a requisition made in writting by President and/or and 3/5th Delegates of the Congregation. Such requisition shall specify the subject of the meeting proposed to be called and must be signed by all the requisitionists and shall be delivered at the office of the Congregation.
 
16. NOTICE OF THE GENERAL BODY/EXTRA GENERAL BODY MEETING:
         Fifteen clear days notice specifying the place, date, time with agenda shall be given to the each and every delegate of Congregation, by hand delivery to their registered address or by Registered Post A.D But the accidental omission to give or not/receipt of such a notice by any member shall not be invalid at the proceeding of any General Body Meeting.
 
17. BUSINESS OF THE ANNUAL GENERAL BODY MEETING:
         The business of the Annual General Body Meeting shall be:
a) To confirm the minute of the previous Annual General Body Meeting.
b) To adopt the previous years and audited statement of documents.
c) To elect the Managing Committee for the next terms, if the term is over.
d) To admit new members as per decision taken by the Managing Committee.
e) To appoint Advocate/Legal Advisor, Chartered Accountant and fix their remuneration`s
f) To consider any other matter, due notice of which has been given five days prior to the General Body Meeting.
 
18. QUORUM OF THE GENERAL BODY MEETING:
         The Quorum of the General Body Meeting shall be 1/3rd of members of Congregation on record. Any Adjourned meeting for want of quorum shall be held half an hour later at the same place and the members present shall form the quorum. But no business other than that specified in the notice shall be transacted at such meeting.
 
19. ELECTION:
         The Election shall take place after every 5 years in the General Body Meeting by show of hands or votes.
 
All delegates are representatives of BCI and Sangha community. So, they should have good Buddhist education, good practice and good personality.
 
* Conditions to elect a president in charge and head vice president in charge:
1 - He has at least 3 generations of Buddhist family. It means that his father and grandfather are Buddhists.
2 - He has been Bhikkhu at least 15 years up.
3 - He was completed at least high school.
4 - He had good Buddhist education and practice.
5 - He did not have any debts or commit any crimes.
6 - He has a good background.
7 - He has good knowlegdes and experiences of manegement.
8 - He has a good personality and has been trustful by Sangha community.
9 – Only President in charge and head vice president in charge should be elected by all memberships. Others delegates are able to elect by all delegates of BCI.
10 - President in charge and head vice president in charge can be elected maximum 3 terms.
* Commen rules and regulations:
1 - All delegates must deliver a curiculum vitae, general education certificates and Buddhist certificates one year before election.
2 - All delegates can not be elected; If they commit silas (precepts), commit crimes or have debts.
3 - All delegates will be elected by a majority 51% up (or 3/5th) of all the delegates of BCI.
4 - Secretary will notify the namelists of all voters whom elected President in charge and others in front of the Sangha community, on newspapers, or on online. Then everyone are able to check their votes exactly or not.
5 - The delegates have already been elected by majority of delegates of BCI. Then everyone should be happy to accept and pay respect to them. No one are not allow complain or causes fighting. All the delegates are temporary representatives in 5  years for BCI, for Sangha and for Buddhists. They have big responsibilities for developement of Buddhism.
6 - The election is for a term 5 years. After 5 years, all delegates `s term will automatically be expired. So, we make new election.
7 - Election will be organised on December 01. The term start on January 01.
8 - If voters are absent in election time, then their votes will be deleted.
9 - If the delegate would like to resign. Then he can send resign application form to BCI.
10 - Treasurer report the Congregation `s financials monthly. If anyone use the Congregation `s financials so much for personality. BCI may be send this case to the court.
11 - All members must be honest, faithful and trustful in BCI and in Sangha community.
12 - The delegates must inform head secretary. In the case, he can not join in meeting. If the delegates do not take part in meeting so many times. Then BCI can change new delegate.
13 - All delegates have responsibility to complete their duties and send report to BCI.
14 - Everyone are freely to give suggestions by letters or applications to BCI. A majority of all delegates accept it. Then BCI will do apply this matter.
15 - All delegates do not cause disunity, if who cause disunity and divide the Sangha, they will be expelled from BCI.
16 - After election, all delegates will vow to follow BCI`s rules, regulations and to vow to complete BCI `s duties in front of Sangha community.
17 - All the delegates do just only Buddhist services for BCI. No one are allow to do political works, business works, .etc . .
18 - The rules and regulations can be changed by majority 51% up of all delegates. Individual is not allow to change the Buddhist Congregation `s rules and regulations.
19 - The Buddhist Congregation is representative for Sangha community. Sangha community manages all the activities of BCI. What regards to Sangha community, financials and constructions of BCI, then all delegates have to organise meeting. These matters will be decides by majority 51% up of all delegates. Individual is not allow to decide them alone.
20 - Yearly meeting are two times a year, on the first june and the first december.
21 - All members have to memorize the Congregation `s rules and regulations.
22 - All members have to unite each other and to cooperate each other in order to protect Buddhist Congregation and Sangha community.
 
20. SOURSE OF INCOME:
         Congregation shall raise their funds by way of subscription, contribution, membership fees, grants, bank interests, donation in cash or in kind.
 
21. BANK ACCOUNT:
         The Managing Congregation shall open Bank Accounts/Accounts in Nationalized Bank/ scheduled Bank/ Cooperative Bank approved by the Government in the same of Congregation/Society/Mandal and shall be operated and signed by jointly at least two office bearers out of President, Secretary and Treasurer.
 
22. SUB COMMITEE/COMMITTEES:
         The Managing Committee shall have power to appoint sub commitee or committees as and when necessary and which the President of Congregation shall preside over these sub delegate or delegates.
 
23. BOOKS OF ACCOUNTS:
         The Managing Committee shall direct the Treasurer to keep the accounts, up to date, and/or the help of the auditor specifically appointed for the purpose and shall be audited by a qualified Chartered Accountant regularly.
 
24. EXPENSES ON THE OBJECT:
         The funds of the Congregation should be used for the full fillment of the objects of the Congregation as specified in the Memorandum of Congregation.
 
25. PROVISION REGARDING SALE AND PURCHASE OF IMMOVABLE PROPERTY:
         Congregation can sell its property in the name of the Congregation as decided by General Body Meeting with prior permission of the Charity Commissioner.
 
26. PROVISION REGARDING LOANS AND DEPOSIT:
         Managing Committee shall have power to keep Congregation Deposit in Nationalized Bank/scheduled Bank/Cooperative bank approved by the Government and also it shall have power to raise interest, free loans from any Individual Body or institution for requirement of Congregation by taking permission of the Charity Commissioner.
 
27. MEMBERSHIP REGISTER TO BE KEPT:
         A Member up to date register of members who are members within the meaning of section15 of the Societies Registration Act, 1860 will be maintained in the form of schedule VI to the Societies Registration (Maharashtra) Rules, 1971 vide Rule 15 thereof.
         This membership register shall be produced at the time of General Body Meeting for the verification of the General Body.
 
28. CUSTODY OF THE DOCUMENTS:
         Any important papers connected to the Congregation shall be kept at the registered office and/or any other suitable place as per the decision of the Congregation.
 
29. PROVISION FOR AMENDMENTS IN RULES AND REGULATIONS:
         This change shall be take place by 3/5th majority of General Body Meeting.
 
30. PROVISION FOR CHANGE IN NAME AND OBJECT OF THE CONGREGATION:
         This Change shall be take place according to Section of 12 and 12 – A of the Societies Registration Act, 1860.
 
31. DISSOLUTION:
         Buddhist Congregation is representative of Indian Buddhism and Indian Sangha Community. Sangha Community shall manage Congregation `s activitives and to develope Buddhism. So Sangha Community shall maintain BCI from time to time and forever. Noone allows to dissolute BCI and noone allows to disunit Sangha Community.
